Site Development
We may freely use for self-promotion any site developed by Iron Horse.
We will neither develop nor host any site which will discredit Iron Horse's reputation.
The Contract for Work (both Site Development and Site Updates) may be verbal, by email or in writing.
Once the Contract is agreed we cannot guarantee to meet our client's priorities but we shall do our best.
All material supplied by the client will remain the client's property.
All such material will be assumed to be free to use without fear of breach of copyright laws.
Iron Horse websites will display acceptably in Internet Explorer versions 6, 7, 8 and Mozilla FireFox version 2.
We will optimise Iron Horse websites such that Google searches using specific key phrases will return the website in the first three pages.
Iron Horse reserves the right to determine appropriate key search phrases.
Site Hosting
Iron Horse will host using its own servers.
Iron Horse will register an appropriate Domain Name where available.
Where the Domain Name is already registered to the Client, it is the Client's responsibility to manage the A- and MX-record redirection as instructed by Iron Horse.
The servers hosting our Client's websites are guaranteed to be available 99.5% of the time.
Periodic maintenance will be performed on Thursdays, between 12:00AM and 01:00AM. The servers may be restarted during these times.
Iron Horse shall be responsible for backing up Client websites and ensuring that at all times there is an off-site copy.
Site Maintenance
We will do our best to meet our Client's priorities but deadlines cannot be guaranteed.
All material supplied by the client will remain the client's property.
All such material will be assumed to be free to use without fear of breach of copyright laws.
eMail Services
Where EMail services are provided these shall not be used for spam.
Because of the reputational and legal risk to Iron Horse, any Client found to be sending spam will have
their service immediately discontinued and will be reported to the appropriate authorities.
Payment
Unless an alternative arrangement has been agreed, Clients will be invoiced annually.
The first annual payment is required before the website goes "Live".
Payment to be made within the timeframe on the invoice.
Non-payment will ultimately result in termination of all services including removal of website.
Ownership of Copyright
Website ownership will be transferred to the Client upon full payment of the first Invoice.
Source files will remain the property of Iron Horse.
Termination of Contract
The Contract may be terminated at any time by the Client.
Upon termination the website files (excluding the source files) will be made available to the Client for a period of 30 days.
The domain name will be available for transfer to a party nominated by the client for a period of 30 days.
There will be no refund or part refund of payment upon termination.
Gross breach of email services will result in immediate termination of services.
Content which is illicit, illegal, or damaging to Iron Horse's reputation, may result in termination of services.
By agreeing to these terms and conditions your statutory rights are not affected.
